Common exemption codes

Q. I have a question regarding a US TIN for Chapter 3 exemption code 04.  I recently attended the webinar for IRS form 1042 Compliance and there was a section where IOFM (page 15) talked about “Common Exemption Codes”. I would like to clarify if these exemption codes apply for all W-8BEN holders. In other words, would it be sufficient to have only a foreign TIN on a W-8BEN-E for a supplier that has a tax treaty (0% withholding rate) where we did not withhold at the 30% rate? Wouldn’t the rule…
