Settlement payment for copyright infringement

Q.¬†We are issuing a settlement payment on copyright infringement. The check is being made payable to plaintiff's counsel only. The plaintiff is refusing to provide a W-9 because he isn't going to be a party on the check and has never had to provide a W-9 before in prior settlements. Please advise if the plaintiff must provide a W-9 if his name isn't on the check. Does it make a difference if the check is payable solely to plaintiff's law firm as to who should receive a 1099? A.
