Q. We have new vendor who is located in Sweden, and they have a full-time U.S.-citizen salesperson in the U.S. to generate sales in the U.S. The vendor provided a W-8BEN-E instead of a W-8ECI, claiming they don't file a U.S. tax return. Should they be filing under a U.S. FEIN and providing W-8ECI instead? A.  (Answered by IOFM's third-party tax expert) Neither we, nor you, can make the final determination on this.
