Who Files Form 1099-S: Settlement Agent or Escrow Agent?

Q. I need clarification regarding if we as a law firm need to process 1099S forms and request W9 forms for real estate transactions.
We are not the settlement agent. The funds were placed into escrow from the Buyer for a real estate transaction. We then wired the funds. We (the law firm) have them complete a certification, authorization and information sheet.
Is it the settlement agent or the escrow agent that needs to request the W9 forms and complete the 1099S forms?
