Q. I have one W-8BEN-E that has 0 % rate of withholding. I am unsure of the status code to use for box 12b. I work for a municipality and do not see the status that we fall under. Am I obligated to file the 1042-S? A. (Answered by IOFM's third-party tax experts) As a municipality, your city uses 20 in box 12b as the "ch. 3 status code".  You must also fill in 02 in box 12c as the "ch. 4 status code.  For 12b there is a specific instruction deep in the IRS Instructions for Form 1042-S, page 26…
